These Terms of Service ("Terms") govern your access to and use of the mobile applications, website, and eSIM connectivity services (collectively, the "Services") provided by Evolviax Inc. ("Evolviax", "we", "us", or "our"). By accessing or using our Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years of age to use our Services. By using our Services, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. eSIM Services

Our Services enable you to purchase, activate, and manage eSIM data plans on compatible devices. Please note the following:

• Device Compatibility: eSIM functionality requires a compatible device. It is your responsibility to verify that your device supports eSIM before purchasing a plan.
• Activation: eSIM profiles are delivered digitally and activated on your device. Once an eSIM profile has been activated, it cannot be transferred to another device.
• Coverage and Performance: Data coverage, speeds, and availability depend on our telecommunications partners' networks and may vary by location. We do not guarantee specific speeds or uninterrupted service.
• Data Plans: Each plan specifies data allowance, validity period, and supported regions. Data usage is measured by our systems and our telecommunications partners' networks.

4. Payments and Refunds

All purchases are processed in the currency displayed at the time of purchase. Prices are subject to change without prior notice. Payments are processed through third-party payment processors.

Refund requests will be evaluated on a case-by-case basis. eSIM profiles that have been activated and used may not be eligible for a full refund. To request a refund, please contact us at dev@evolviax.ca.

5. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Services for any illegal or unauthorized purpose
• Attempt to resell, redistribute, or commercially exploit the data plans without our written consent
• Interfere with or disrupt the integrity or performance of the Services
• Attempt to gain unauthorized access to our systems or networks
• Use the Services in a manner that could damage, disable, or impair our infrastructure

6. Intellectual Property

All content, features, and functionality of our Services — including but not limited to text, graphics, logos, icons, software, and design — are owned by Evolviax Inc. and are protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of our Services without our prior written consent.

7. Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Evolviax Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Services shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account and access to the Services at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Services will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

11. Changes to These Terms

We may revise these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website with a revised "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
